These Terms and Conditions ("Terms") govern your use of the Caluru mobile application ("the App") provided by Centralized Operations Management LLC ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of Service

Caluru is a nutrition tracking and meal planning application that helps you:

• Track daily nutrition (calories, protein, carbohydrates, fat)
• Plan weekly meals and generate shopping lists
• Browse and create recipes
• Scan barcodes and food photos to identify nutritional content
• Receive AI-powered nutrition advice through an in-app Assistant
• Monitor weight and fitness progress

Some features require an internet connection. Optional Sign in with Apple and iCloud sync are available for cross-device access.

2. Eligibility

You must be at least 16 years old to use Caluru. By using the App, you represent that you meet this age requirement. If you are under 18, you confirm that you have parental or guardian consent to use the App.

3. Not Medical Advice

Caluru provides nutrition information for educational and informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

• Always consult a qualified healthcare provider before making significant changes to your diet or exercise routine.
• Do not disregard professional medical advice or delay seeking it because of information provided by the App.
• Nutrition targets and calculations (e.g., Mifflin-St Jeor BMR) are estimates and may not be accurate for every individual.
• If you have a medical condition, eating disorder, food allergy, or are pregnant or breastfeeding, consult a healthcare professional before using the App.

4. AI-Generated Content

The App includes an AI Assistant and food photo recognition powered by third-party AI services (OpenAI). You acknowledge that:

• AI-generated suggestions, meal plans, and nutritional estimates may be inaccurate or incomplete.
• You are responsible for verifying AI-generated content before acting on it.
• We are not liable for decisions you make based on AI-generated content.
• Food photo analysis results are estimates and should not be relied upon as precise nutritional data.

5. User Responsibilities

When using Caluru, you agree to:

• Provide accurate information in your profile and food logs
• Use the App only for personal, non-commercial purposes
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not use the App to transmit harmful, offensive, or illegal content
• Not interfere with or disrupt the App's infrastructure or third-party services
• Keep your Apple ID credentials secure if you use Sign in with Apple

6. Subscriptions & In-App Purchases

Caluru may offer optional premium features through in-app subscriptions or one-time purchases processed by Apple via the App Store. Subscription entitlements are managed with RevenueCat. If you purchase a subscription:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel subscriptions in your Apple ID Account Settings.
• Free trial periods, if offered, convert to a paid subscription unless cancelled before the trial ends.
• Refunds are handled by Apple in accordance with their refund policies.

Pricing and available plans are displayed in the App at the time of purchase. We reserve the right to change pricing with reasonable notice.

7. Intellectual Property

The App, including its design, code, content, recipes, and branding, is owned by Centralized Operations Management LLC and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes. You retain ownership of content you create (e.g., custom recipes, food logs), but grant us a license to process it as needed to provide the service.

8. Third-Party Services

The App integrates with third-party services including Apple (iCloud, Sign in with Apple, App Store), Supabase, OpenAI, Open Food Facts, and RevenueCat. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

9. Data & Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to the data practices described in the Privacy Policy.

10. Account & Data Deletion

You may stop using the App and delete your data at any time through the account reset option in the App settings. Uninstalling the App removes local data. iCloud data can be managed through your Apple ID settings. We are not obligated to retain your data after deletion.

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or for any other reason at our discretion. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and governing law) will survive.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT NUTRITIONAL DATA WILL BE ACCURATE OR COMPLETE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CENTRALIZED OPERATIONS MANAGEMENT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR €50, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Centralized Operations Management LLC from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by updating the "Last updated" date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of Spain and the European Union, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Spain, unless mandatory consumer protection laws in your country of residence require otherwise.

Estos Términos y Condiciones ("Términos") rigen el uso de la aplicación móvil Caluru ("la App") proporcionada por Centralized Operations Management LLC ("nosotros" o "nuestro"). Al descargar, instalar o usar la App, aceptas quedar vinculado por estos Términos. Si no estás de acuerdo, no uses la App.

1. Descripción del Servicio

Caluru es una aplicación de seguimiento nutricional y planificación de comidas que te ayuda a:

• Registrar tu nutrición diaria (calorías, proteínas, carbohidratos, grasas)
• Planificar comidas semanales y generar listas de la compra
• Explorar y crear recetas
• Escanear códigos de barras y fotos de alimentos para identificar contenido nutricional
• Recibir consejos nutricionales con IA a través de un Asistente en la app
• Monitorear tu peso y progreso fitness

Algunas funciones requieren conexión a internet. El inicio de sesión opcional con Apple y la sincronización con iCloud están disponibles para acceso entre dispositivos.

2. Elegibilidad

Debes tener al menos 16 años para usar Caluru. Al usar la App, declaras que cumples este requisito de edad. Si eres menor de 18 años, confirmas que tienes el consentimiento de tus padres o tutores para usar la App.

3. No es Consejo Médico

Caluru proporciona información nutricional solo con fines educativos e informativos. No sustituye el consejo, diagnóstico o tratamiento médico profesional.

• Consulta siempre a un profesional de la salud cualificado antes de realizar cambios significativos en tu dieta o rutina de ejercicio.
• No ignores el consejo médico profesional ni retrases su búsqueda por información proporcionada por la App.
• Los objetivos y cálculos nutricionales (p. ej., TMB de Mifflin-St Jeor) son estimaciones y pueden no ser precisos para cada persona.
• Si tienes una condición médica, trastorno alimentario, alergia alimentaria, o estás embarazada o en periodo de lactancia, consulta a un profesional de la salud antes de usar la App.

4. Contenido Generado por IA

La App incluye un Asistente de IA y reconocimiento de fotos de alimentos impulsado por servicios de IA de terceros (OpenAI). Reconoces que:

• Las sugerencias, planes de comidas y estimaciones nutricionales generadas por IA pueden ser inexactas o incompletas.
• Eres responsable de verificar el contenido generado por IA antes de actuar sobre él.
• No somos responsables de las decisiones que tomes basándote en contenido generado por IA.
• Los resultados del análisis de fotos de alimentos son estimaciones y no deben considerarse datos nutricionales precisos.

5. Responsabilidades del Usuario

Al usar Caluru, aceptas:

• Proporcionar información precisa en tu perfil y registros de comida
• Usar la App solo para fines personales y no comerciales
• No intentar realizar ingeniería inversa, descompilar o desensamblar la App
• No usar la App para transmitir contenido dañino, ofensivo o ilegal
• No interferir ni interrumpir la infraestructura de la App o los servicios de terceros
• Mantener seguras tus credenciales de Apple ID si usas Iniciar sesión con Apple

6. Suscripciones y Compras dentro de la App

Caluru puede ofrecer funciones premium opcionales mediante suscripciones o compras únicas procesadas por Apple a través de la App Store. Los derechos de suscripción se gestionan con RevenueCat. Si adquieres una suscripción:

• El pago se carga a tu cuenta de Apple ID al confirmar la compra.
• Las suscripciones se renuevan automáticamente a menos que se cancelen al menos 24 horas antes del final del periodo actual.
• Tu cuenta se cargará por la renovación dentro de las 24 horas previas al final del periodo actual.
• Puedes gestionar y cancelar suscripciones en la Configuración de tu cuenta de Apple ID.
• Los periodos de prueba gratuita, si se ofrecen, se convierten en suscripción de pago a menos que se cancelen antes de que finalice la prueba.
• Los reembolsos los gestiona Apple de acuerdo con sus políticas de reembolso.

Los precios y planes disponibles se muestran en la App en el momento de la compra. Nos reservamos el derecho de cambiar los precios con un aviso razonable.

7. Propiedad Intelectual

La App, incluido su diseño, código, contenido, recetas y marca, es propiedad de Centralized Operations Management LLC y está protegida por las leyes de propiedad intelectual. Se te concede una licencia limitada, no exclusiva e intransferible para usar la App con fines personales. Conservas la propiedad del contenido que creas (p. ej., recetas personalizadas, registros de comida), pero nos otorgas una licencia para procesarlo según sea necesario para proporcionar el servicio.

8. Servicios de Terceros

La App se integra con servicios de terceros, incluidos Apple (iCloud, Iniciar sesión con Apple, App Store), Supabase, OpenAI, Open Food Facts y RevenueCat. Tu uso de estos servicios está sujeto a sus respectivos términos y políticas de privacidad. No somos responsables de la disponibilidad, exactitud o prácticas de los servicios de terceros.

9. Datos y Privacidad

Tu uso de la App también se rige por nuestra Política de Privacidad, que describe cómo recopilamos, usamos y protegemos tus datos. Al usar la App, consientes las prácticas de datos descritas en la Política de Privacidad.

10. Eliminación de Cuenta y Datos

Puedes dejar de usar la App y eliminar tus datos en cualquier momento a través de la opción de restablecer cuenta en la configuración de la App. Desinstalar la App elimina los datos locales. Los datos de iCloud se pueden gestionar a través de la configuración de tu Apple ID. No estamos obligados a conservar tus datos tras la eliminación.

11. Terminación

Podemos suspender o terminar tu acceso a la App en cualquier momento, con o sin previo aviso, si violas estos Términos o por cualquier otra razón a nuestra discreción. Tras la terminación, tu derecho a usar la App cesa inmediatamente. Las disposiciones que por su naturaleza deban sobrevivir a la terminación (incluidas las exenciones de responsabilidad, limitaciones de responsabilidad y ley aplicable) seguirán vigentes.

12. Exención de Garantías

LA APP SE PROPORCIONA "TAL CUAL" Y "SEGÚN DISPONIBILIDAD" SIN GARANTÍAS DE NINGÚN TIPO, YA SEAN EXPRESAS O IMPLÍCITAS, INCLUIDAS, ENTRE OTRAS, LAS GARANTÍAS IMPLÍCITAS DE COMERCIABILIDAD, IDONEIDAD PARA UN FIN PARTICULAR Y NO INFRACCIÓN. NO GARANTIZAMOS QUE LA APP SEA ININTERRUMPIDA, LIBRE DE ERRORES O SEGURA, NI QUE LOS DATOS NUTRICIONALES SEAN PRECISOS O COMPLETOS.

13. Limitación de Responsabilidad

EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY APLICABLE, CENTRALIZED OPERATIONS MANAGEMENT LLC NO SERÁ RESPONSABLE DE NINGÚN DAÑO INDIRECTO, INCIDENTAL, ESPECIAL, CONSECUENTE O PUNITIVO, NI DE NINGUNA PÉRDIDA DE BENEFICIOS, DATOS O FONDO DE COMERCIO, DERIVADA DE TU USO DE LA APP. NUESTRA RESPONSABILIDAD TOTAL POR CUALQUIER RECLAMACIÓN DERIVADA DE ESTOS TÉRMINOS O TU USO DE LA APP NO EXCEDERÁ LA CANTIDAD QUE NOS HAYAS PAGADO EN LOS DOCE (12) MESES ANTERIORES A LA RECLAMACIÓN, O 50 €, LO QUE SEA MAYOR.

Algunas jurisdicciones no permiten la exclusión de ciertas garantías o la limitación de responsabilidad, por lo que algunas de las limitaciones anteriores pueden no aplicarse en tu caso.

14. Indemnización

Aceptas indemnizar y eximir de responsabilidad a Centralized Operations Management LLC de cualquier reclamación, daño, pérdida o gasto (incluidos honorarios legales razonables) derivados de tu uso de la App, tu violación de estos Términos o tu violación de los derechos de un tercero.

15. Cambios en estos Términos

Podemos actualizar estos Términos periódicamente. Te notificaremos los cambios significativos actualizando la fecha de "Última actualización" en la parte superior de esta página. El uso continuado de la App tras los cambios implica la aceptación de los Términos actualizados. Si no estás de acuerdo con los Términos actualizados, debes dejar de usar la App.

16. Ley Aplicable

Estos Términos se rigen e interpretan de acuerdo con las leyes de España y la Unión Europea, sin tener en cuenta los principios de conflicto de leyes. Cualquier disputa derivada de estos Términos estará sujeta a la jurisdicción exclusiva de los tribunales de España, salvo que las leyes obligatorias de protección al consumidor de tu país de residencia exijan lo contrario.
